Subject: Request for Records Date: Sun, 27 Feb 2005 20:08:15 -0800 From: Carrie Lybecker To: jima@portolympia.com Jim Amador Marine Terminal Director 915 Washington St NE Olympia, WA 98501 Dear Mr. Amador: On Feb. 07 I requested to review Port records (letter copied below). On Feb. 25, I received from Jennie Foglia-Jones the following information regarding meetings between Port staff and military agencies: The following documents have been marked SSI (sensitive security information) and are not available for release. Cape Island Pre-Op Meeting Minutes Cape Island Pre-Op Meeting Minutes Cape Kennedy Pre-Op Meeting Minutes Cape Orlando Pre-Op Meeting Minutes Cape Intrepid Pre-Op Meeting Minutes Cape Horn Pre-Op Meeting Minutes Cape Knox Pre-Op Meeting Minutes Could you please confirm that the Port believes these records in their entirety are exempt under the state Open Records Act and if so, the basis for the exemption? If you believe these records are exempt, could you please offer some identifying information regarding the records, for instance, the dates or approximate dates of the meetings and the agencies involved, so that I can contact these agencies directly for further information? In requesting the above information, I've relied on the following from the Attorney General's web site: Denials of requests must be made in writing and state specifically the reasons for the denial. RCW 42.17.320. The written response must identify the specific exemption on which the agency relies and a brief explanation of how that exemption applies to the records requested. RCW 42.17.310(4). In order to ensure compliance with the Act and to provide an adequate record for a reviewing court, the agency's response to a request for documents must include a means of identifying any individual records being withheld in their entirety . . . Agencies are not relieved of their obligations to respond to requests for public records because a portion of the document contains information covered by an exemption. An agency has a duty to delete or redact specific information covered by an exemption and disclose the remainder of the document. http://www.atg.wa.gov/records/chapter3.shtml#3.3 I appreciate your assistance. Also, Jennie has been a public relations model: helpful and informative to the public, while positively representing the interests and goals of the Port. Thank you, Carrie Lybecker 10020 Mariner Dr NW Olympia, WA 98502 360-867-9501 Port of Olympia 915 Washington St NW Olympia, WA 98501 February 07, 2005 I would like to inspect all records of the Port of Olympia, Port Commission, and Thurston County Port district, from January 01, 2004 through February 07, 2005, related to the use of the Port of Olympia by the US Armed forces, Coast Guard, or other military agencies; the transport of military equipment and supplies to, from and through the Port of Olympia; the presence of military vessels, materials and personnel in the Port of Olympia; and the establishment and operation of a security zone in the Port of Olympia.
